Please join us on Wednesday, 6/12 at 1 pm eastern for a call to discuss a recent Eighth Circuit decision. The issue is whether government defendants may be held liable under section 1983 for inaccurately determining that a man encountered during a winter emergency response was dead rather than suffering from hypothermia, and so informing subsequent Emergency Responders arriving at the scene? We will discuss whether this scenario fits the several narrow exceptions ( such as Special Duty Rule, or creating/enhance danger) warranting jury consideration of municipal liability.
